Terms of Service Agreement

If you request, order, purchase or acquire art (works) from me (RuneTyphoon) it means you, the client, have read, understood, and agreed to the following terms. These terms are subject to change without notice.

I. GENERAL DISCLAIMERS

  • I reserve the right to refuse or discontinue a commission at any time.

  • The terms outlined here may vary slightly depending on the type of commission and will be discussed with the client.

II. PAYMENT AND FEES

  • Payment is due in full upfront (unless discussed and agreed to otherwise)

  • Payment is done through PayPal invoice using CAD (Canadian dollar) rates. ($1. CAD = $0.75 USD)

  • Additional fees will be charged for excessive or major revisions.

  • The exact prices for the fees described above will be dependant upon the complexity of the commission.

III. PROCESS AND WORK SCHEDULE

  • I will send over a sketch for approval before continuing a commission.

  • I will show works in progress (WIPs) via email throughout the commission process unless specified otherwise.

  • Sketches and subsequent in-progress shots will initially be sent as low-res, watermarked images.

  • I will always do my best to complete your commission within a timely manner, but please understand that sometimes life and health may get in the way and cause a delay in completing your commission. I will notify you as soon as possible of any issues that come up to keep you informed.

IV. REVISIONS

  • Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.

  • Revisions due to my own negligence are free.

  • Additional major revisions will incur additional fees.

  • It is up to my discretion as to what constitutes minor and major revisions.

V. COPYRIGHT AND USAGE POLICY

  • I, the artist, retain the rights over any commissioned works.

  • I reserve the right to post the commissioned work on my social media.

  • I reserve the right to stream, record, and upload videos of the creation of the artwork.

  • Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.

  • The final product is strictly for your personal use only, unless you purchase commercial rights.

  • You must credit and link back to me/tag me when sharing or using the commissioned work.

  • For commercial use, you must purchase the rights from me at 300% the original price.

  • Credit is still required when using the work in any form commercially.

You may use or edit the commissioned work in the following ways:

  • Print the work for personal use.

  • Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.

  • Use the artwork as reference for a study.

  • Post the artwork on social media, with credit to me clearly visible.

You may NOT use or edit the commissioned work in the following ways:

  • Claim the artwork as yours.

  • Remove my watermark/signature.

  • Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.

  • Color in my sketches or lineart.

  • Use the commissioned piece in any technology related to NFTs, cryptocurrency, or AI.

  • Reproduce the work commercially without purchasing the rights from me.

VI. CANCELLATION AND REFUNDS

  • Once the final product is approved, a refund is not permitted.

  • You may cancel the commission any time, after which I will issue a refund equivalent to the amount of work not done.

  • I reserve the right to cancel and refund the money for your commission at any time.

  • You may not file a chargeback against me after you have given approval of the artwork.

VII. WHAT YOU RECEIVE

  • You will receive the following after client approvals at the appropriate stages of the commission process. Images are always sent as 300 DPI PNGs unless another resolution/file type is requested:

  • Final sketch

  • Flat color sketch (not available for all commission types)

  • Final artwork

ADOPTABLES.You recognize RuneTyphoon as the Adoptable's creator.
* After you've successfully purchased or acquired an Adopt from us, we've received your payment for the Adopt (if applicable), and you've received the Adopt's file(s), you become the Adopt's owner, and there is no refund (if applicable). Being the Adoptable's owner gives you the right to use the character in accordance to these terms.
* You can make any changes you wish in the Adopt's design, give them a name, gender, story, etc.
* Personal use allowed.
* Commercial use prohibited. The original file(s) and artwork cannot be used for merch that you sell, either physical or digital.
* For Adopts you've purchased, you may trade, give them away, gift or resell them (for no more than the amount you paid, unless they come with extra art that you've commissioned).
* For Adopts you have acquired without paying (via trade, gift, raffle, giveaway, etc.), you may trade, gift or give them away, but you aren't allowed to sell them.
* If you transfer your Adopt to another person, in which case that person becomes the Adopt's owner (and you're no longer the Adopt's owner), via any way we've mentioned, you must give the new owner at least the original files you got of the Adopt. The new owner must know that the Adopt was designed by us, and they must agree to these terms. Please understand that we cannot mediate between you and the new owner if a problem arises between you two.

What programs do you use?I currently use Clip Studio Paint EX for art and animation and FlipaClip for animation.
In the past I have used Paint Tool Sai 1+2, TV Paint 10, FireAlpaca, and Vegas Pro 18, among others.What devices do you use?I use a Wacom 2017 Intuos Draw and I have recently upgraded to an Apple IPad Pro 11.Whats your usual TAT (Turnaround time)?It depends on the complexity of the commission. The TAT I usually give is 4 months, however, I aim from anywhere to one week to 2 months usually.Do you send WIPs (Work in progress)?Absolutely. I also do my best to update the client and also ask frequently if anything would like to be changed or adjusted for the client.What about your health may prevent progress?This question is here more so for the sake of being transparent and honest with my clients.
I am diagnosed with several health conditions both physical and mental. The most prominent that may prevent progress is De Quervain Tenosynovitis in both of my wrists and Fibromyalgia. These are not my only health concerns, but are the ones that specifically would prevent progress due to the inability to physically draw.Do you have a Patreon?No. Maybe in the future, but for now I am using and updating another subscription service called SubscribeStar.
